LA NECESARIA Y DIFÍCIL LIMITACIÓN A LA POTESTAD DE REVISIÓN DE LA ADMINISTRACIÓN PÚBLICA.
La potestad de revisión de la Administración supone una prerrogativa exorbitante, que ha de contar con límites en su ejercicio, a ello responde la figura aquí estudiada. Sin embargo, estos límites cuentan con importantes dificultades en su aplicación práctica. Este trabajo intenta contribuir a dar luz al respecto a través de un estudio de su propia esencia y funcionalidad, así como de los presupuestos y, especialmente, los principios que han de tomarse en consideración. Se trata además de un tema sumamente relevante en la práctica jurídica diaria, del que conocen tribunales y respecto del que dictaminan los órganos consultivos, sin que exista unanimidad al respecto, ni criterios claros que aporten certeza. Precisamente la base de esta cuestión se encuentra en el conflicto entre el principio de seguridad jurídica y el principio de legalidad y, su finalidad última, a mi juicio, es la equidad misma.
The power of revision of the Administration supposes an exorbitant prerogative, which must have limits in its exercise, to which the figure studied here responds. However, these limits have significant difficulties in their practical application. This work tries to contribute to shed light on this matter through a study of its own essence and functionality, as well as basis and, especially, the principles to be taken into consideration. It is also a highly relevant issue in daily legal practice, which courts are aware of and regarding which the advisory bodies rule, without there being unanimity in this regard, nor clear criteria that provide certainty. Precisely the basis of this issue lies in the conflict between the principle of legal certainty and the principle of legality and, its ultimate purpose, in my opinion, is equity itself.
