LA NECESIDAD DE LA PLANIFICACIÓN DE LA CONTRATACIÓN COMO GARANTÍA DE TRANSPARENCIA, DEL USO ESTRATÉGICO DE LA CONTRATACIÓN PÚBLICA Y DEL USO ADECUADO DE LOS PROCEDIMIENTOS DE CONTRATACIÓN
La aprobación y entrada en vigor de la Ley 9/2017, 8 de noviembre, de Contratos del Sector Público, por la que se transponen al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014 – LCSP -, ha supuesto un desafío y una ventana de oportunidad. El desafío de abordar cambios importantes, incluso de mentalidad, y la oportunidad de conseguir que la contratación pueda ser, de una vez por todas, el instrumento estratégico más importante para la implantación de políticas públicas.
Pero para saber es si es posible enfrentar exitosamente el desafío, teniendo en cuenta los esfuerzos de planificación, a todos los niveles, que requiere.
The approval of the law 9/2017, 8 of November,–LCSP-, it poses a challenge and a window of opportunity. The challenge of addressing important changes including mentality and the opportunity to ensure that recruitment can once and for all be the most important strategic instrument for the implementation of public policies.
But the question is whether it is possible to face the challenge successfully, taking into account the planning efforts, at all levels, that it requires.
