LOS ANIMALES COMO NUEVOS MIEMBROS DE LA FAMILIA
Este artículo se centra en realizar un glosario de las diferentes reformas que ha conllevado la nueva Ley 17/2021, del 15 de diciembre, de modificación del Código Civil, la Ley Hipotecaria y la Ley de Enjuiciamiento Civil, sobre el régimen jurídico de los animales. Para ello, se inicia con un repaso de las razones principales que han motivado la reforma, intentando a la vez entender el motivo que existe detrás de cada uno de los cambios en concreto. Además, se compara la nueva normativa con el régimen anterior para, con ello, lograr entender cuáles eran los problemas y fallos en los que incurría la normativa previa y comprobar si la nueva los ha solucionado. Por último, se finaliza con un repaso de las diferentes críticas que la nueva ley y las que aún están por venir en esta materia han suscitado, intentando con ello adelantar los posibles errores y obstáculos que se produzcan.
This paper focuses on making a glossary of the different reforms that the new Act 17/2021, of December 15, has entailed on the legal regime of animals. To do this, it begins with a review of the main reasons that have motivated the reform, trying to understand the reason behind each specific changes at the same time. Furthermore, the new regulation is compared with the previous one in order to understand what were the problems and failures of the previous regulations and check if the new ones have solved them. Finally, it ends with a review of the different criticisms that this new Act and those that are yet to come in this subject have raised, trying to anticipate possible errors and obstacles.
