¿UN NUEVO MODELO DE CONTRATACIÓN MENOR EN LA LEY 9/2017, DE 8 DE NOVIEMBRE, DE CONTRATOS DEL SECTOR PÚBLICO?
La aprobación de la Ley de Contratos del Sector Público de 2017 ha dado lugar a una gran literatura científica pero, quizá, uno de los aspectos sobre los que más se ha escrito ha sido sobre la contratación menor. La nueva ley pretende que aquella sea utilizada para lo que fue creada en su momento, satisfacer necesidades públicas extraordinarias y no recurrentes cuya cuantía fuera escasa, y para ello establece nuevos requisitos que, tras haber transcurrido ya unos meses desde su aprobación, han tenido como consecuencia la reducción de la utilización de la contratación menor.
Much has been written about the new public sector procurement Law of 2017, and between it, especilly on the minor procurement. One of the objetives of the new law is that the minor procurement be used to meet extraordinary and not reiterted needs, because that was the purpose for which the minor procurement was created. To do this, the new law establishes new requirements to use the minor procurement, whose consequence after several months of application of the new law has been the reduction of minor procurement.
